Corporate Manslaughter Trial Starts18 May 2011
It is fair to say that the Corporate Manslaughter Act 2007 has not had the best start, its introduction was delayed and now because of the case between Cotswold Geotechnical Holdings being dropped to some degree because the managing director Peter Eaton is now ill and has suffered from serious health problems. The Act is under a big black cloud and people are starting to ask significant questions.
The CPS is still decided to press on with Cotswold Geotechnical Holding even after two years and the fact the company is no longer trading there is very little prospect of a significant fine being levied, most importantly there is not really going to be any meaningful guidance from this case on how the Corporate Manslaughter Act is going to be interpreted.
Because the case will may make it to trial beware of all the services, products and training that will be sold on the back of this case, don’t get caught up in hype just carry on as you are and stay on the right side of the law.
